Where there is competition, there are also strong emotions and a great deal of pressure. Media involvement in competitive sport can also amplify these strong emotions and lead to misunderstandings and finally to disputes. These disputes can jeopardize athletes’ performances and as well as their image. Mediation is a good way to resolve sport disputes for several reasons. Finding a solution to an issue before it reaches the courts means that disciplinary sanctions can be avoided. (Many football associations provide for this in their statutes). In addition, the private and confidential nature of mediation helps athletes to avoid any concerns over image or sponsorship issues. Finally the principle of mediation in finding a “consent oriented solution” also satisfies the principle of fair play found in sport.
Sports-related disputes can arise between various different parties:
- Sports teams and within sports teams
- Sponsors and athletes
- Coaches and athletes
- Parents and coaches
- Club management and coaches
- Fans and fan clubs
- Issues concerning facilities, scheduling, funding etc.
