The mediator operates in an equal and neutral manner with each party guiding them through the process. The mediator listens to the concerns of each party without favoring the interests of one party over another. Mediation remains strictly confidential. Whatever is said in mediation cannot be repeated or reported by the mediator to another party. This confidentiality preserves both parties from a potential “loss of face” if an issue goes public.
The parties participate of their own will. They can leave at any time, for any reason. As content experts, parties can retain control over the choice of subjects they wish to discuss and solve together. Moreover, parties also retain control over the resolution and as they have been personally involved in creating this solution together, this enables them to engage and identify more with the outcome. They have complete decision-making power, which is not the case when a dispute ends up in court for example, where the parties obtain resolution but the control resides solely with the judge.
